Dealing with Flash Sites
Site taking your game without permission? Decompiling your work? Not responding to your emails?It's not fair that sites can take your work and then never contact you back when you want them to stop hosting it. If you have no clue how to deal with these people, it's time to take action.
If your animation or game was sponsored, contact your sponsor. Many sponsors have a way to get legal consultation. This way, the lawyers can deal with the issue and will know the best steps to get the file removed. In addition, the sponsor could have submitted the file to the site without your knowledge because they sponsored it, so it may actually not be stolen. it could possibly also resolve other stolen files that you may have on the site, or deal with your friend’s files. If your file is all your own, or if you are having problems contacting your sponsor or they do not exist anymore, you have to take matters into your own hands. The first step is to contact the website owner by email. Usually, the website has a contact address somewhere on the website. If the website does not have an email address anywhere on the site, you can look up the website on whois.net, and contact the site owner there. The email should be extremely formal. Immature emails offer up little resolve to problems. Your emails should not be territorial or defensive. For example, Dear ____, After visiting your website ‘www.websitehere.com’, I noticed that my Flash game/animation, “title here”, was being hosted without permission. I would like to have the file removed immediately, and would also request further permission for future flash hosting. Thanks, If no action is taken within a few weeks, you will need to make a decision. You can either continue sending emails, or you can start to flex your copyright muscles. You need to make the judgment call whether the stealing is worth getting wrapped up in lawsuits (99% of the time, which is not the case). Good luck!
